Benson’s Restaurant Group Terms of Use
Please review the following Terms of Use (the “Terms of Use”) which govern your interactions with Benson’s Restaurant Group, LLC and its subsidiaries and affiliates (collectively, “Benson’s,” “we,” or “us”). These Terms of Use constitute a binding agreement between you and Benson’s. Please read carefully through all of the following sections.
1. Agreement; Acceptance of Terms. These Terms of Use apply to your use of our internet and mobile websites (the “Websites”), the Benson’s mobile application (the “App”), your participation in the Benson’s Rewards Program (“Benson’s Rewards”) and other online services (collectively referred to as the “Sites”), and other means by which we may collect information about you (“Personal Information”) and other information from you, including information you may provide to us other than on the Websites, Sites, App, or via Benson’s Rewards.
We encourage you to carefully read these Terms of Use. By accessing or otherwise using the Sites, Websites, App, or by participating in Benson’s Rewards, you agree that you have read and understand these Terms of Use and that you accept and consent to be bound by these Terms of Use, including, but not limited to, any uses and disclosures of Personal Information. Acceptance means you will be bound to these Terms of Use and any modifications of the Terms of Use. It is your sole responsibility to keep yourself informed of the Terms of Use and we encourage you to periodically review the Terms of Use for the latest version. If you do not agree with these Terms of Use, do not access or otherwise use the Websites, Sites, App, or participate in Benson’s Rewards.
These Terms of Use do not apply to any other websites or mobile applications or to information that may be collected by any other websites or mobile applications. Other third parties (such as online reservation platforms or social media networks that you may use in connection with our Websites, Sites, App, or Benson’s Rewards) may also use, collect, and share information about you. We are not responsible for, and these Terms of Use do not apply to, the privacy practices of other companies or other websites or mobile applications. We encourage you to seek out and read the privacy policy of each website that you visit and each mobile application that you use.
2. Scope of Use. You agree to not use the Websites, Sites, or App in any manner which would undermine the integrity of the Websites, Sites, or App, violate the rights of Benson’s, its employees, or other persons, cause injury of any type to any person, or be unlawful under any applicable civil or criminal law. You may only use the Websites, Sites, or App for your personal and informational use. You agree that your use of the Websites, Sites, or App shall comply with all applicable laws, rules, and regulations. You will not post abusive, harassing, harmful, or otherwise objectionable material of any kind onto the Websites, Sites, or App. You agree you will not use any robot, spider, or other technology to copy the Websites, Sites, or App or its contents, unless we grant you express written permission. You also agree to not transmit any files or materials to the Websites, Sites, or App with any viruses, worms, malware, files, or programs that could damage, interfere with, destroy, or limit the functionality of the Websites, Sites, or App.
Benson’s has no obligation, but maintains the right, to monitor the Websites, Sites, or App. We may report to law enforcement authorities any actions that may be illegal, and any reports we receive of such conduct.
3. Permitted Users. We do not specifically target the Websites, Sites, or App to children under 13 years old. If you are under the age of 13, you should only use the Websites, Sites, or App under the supervision of a parent or legal guardian. Use of the Websites, Sites, or App by persons under the age of 13 without the prior permission of a parent or legal guardian is void.
4. User Registration. To access the Websites, Sites, or App, or to join Benson’s Rewards, you may be asked to create an account with us. It is a condition of your use of the Websites, Sites, App, or Benson’s Rewards that all the information you provide is correct, current, and complete, and that you have the authority to provide such information to us. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account or password, or any other breach of security. You may be held liable for losses incurred by us or any other user of the Websites, Services, or App due to someone else using your password or customer account. You may not use anyone else’s password or customer account. You may not attempt to gain unauthorized access to the Websites, Sites, or App, and if you attempt to do so, or assist others in making such attempts, then we may terminate your account. We have the right to prohibit the use of any username, password, or other identifier, whether chosen by you or provided by us, or to close your account for any reason and at any time. All accounts are subject to Benson’s Privacy Policy.
5. Intellectual Property. Unless expressly stated otherwise, the content on the Websites, Sites, or App is the property of Benson’s, its licensors, or suppliers. Such content includes, but is not limited to, text, graphics, images, logos, trademarks, applications, icons, user interface, and the arrangement of the Websites, Sites, and App. The Websites, Sites, and App include and make reference to materials subject to trademarks, patents, trade secrets, and other proprietary rights of Benson’s, its affiliates, licensors, and/or suppliers. No license or right to that material is granted to you by your use of the Websites, Sites, or App. Your use of this protected content, including any modification, reproduction, distribution, sale, or circulation, for any non-personal purpose, is prohibited.
6. Disclaimer of Warranties. Benson’s disclaims all representations and warranties, express, implied, or statutory, not expressly set out in these Terms of Use, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In addition, Benson’s makes no representation, warranty, or guarantee concerning availability, accuracy, omissions, content of information, or suitable use of the Websites, Sites, or App, or to any service, deletion, omission, interruption, communication or transmission failure, unauthorized access to information or record, inability to access the Websites, Sites or App, or computer virus. You agree to use the Websites, Sites, and App at your own risk.
Benson’s will not be responsible for any loss or damage that could result from interception by third parties of any information or Personal Information. Benson’s assumes no responsibility whatsoever and shall not be liable for use of the Websites, Sites, or App, including but not limited to, the content and any errors contained therein. Benson’s shall not be liable for any failure of the Websites, Sites, or App arising or resulting from acts or events beyond the control of Benson’s.
7. Product Descriptions. We use reasonable efforts to ensure that product descriptions and other related information are accurate; however, we make no warranties or representations as to the completeness, accuracy, or reliability of such information.
8. Limitation of Liability. Neither Benson’s nor you shall be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, relating to or otherwise resulting from any use of the Websites, Sites, or App.
The limitations in this section do not purport to limit liability or alter your rights as a consumer that cannot be excluded under applicable law. Benson’s liability shall be limited to the extent permitted by law. This provision shall have no effect on Benson’s choice of law provision set forth below.
9. Electronic Communications. By using the Websites, Sites, or App, you consent to receive electronic communications from us. You may also opt-in for Short Message Service (“SMS”) communications from Benson’s as part of the loyalty registration process for Benson’s Rewards available at https://www.bensonsrestaurantgroup.com/loyalty-program. By opting-in, you agree to receive automated promotional and personalized marketing SMS communications from Benson’s to the mobile phone number you provide during the loyalty registration process for Benson’s Rewards. SMS communications may pertain to promotional programs, new menu items, and other related information. SMS communications will be sent from (414) 928-8919 and will begin with “Benson’s Restaurant Group.” Consent to receive automated SMS communications is not a condition of any purchase. Frequency of SMS communications varies. Message and data rates may apply. You agree that what we provide to you electronically satisfies any legal requirement stating that such communications must be made in writing.
To opt-out of receiving SMS communications, you may text the keyword “STOP” to (414) 928-8919. After texting “STOP” to (414) 928-8919 you will receive one additional message confirming your request to opt-out has been processed. For more information, text the keyword “HELP” to (414) 928-8919 for customer care information. You may also contract Benson’s at rewards@bensonsrestaurants.com for additional assistance.
10. Termination of Access. We reserve the right, without notice, to block your email or IP address for any reason if we believe you have breached any of these Terms of Use.
11. Governing Law; Choice of Forum. These Terms of Use and any dispute arising out of or related to these Terms of Use or your use of the Websites, Sites, or App shall be governed, construed, and enforced in accordance with the laws of the State of Wisconsin, without regard to conflicts of laws of any jurisdiction.
You agree that all controversies and claims brought by you or by us that arise out of these Terms of Use or your use of the Websites, Sites, or App shall be submitted for arbitration before the American Arbitration Association pursuant to the Commercial Dispute Resolution Procedures and the Supplemental Procedures for Consumer Related Disputes. The place of the arbitration shall be Milwaukee, Wisconsin. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
The arbitrator can award the same relief available in court (including injunctive or declaratory relief). The arbitrator may only award final relief in favor of the individual party seeking relief and only to the extent necessary to provide final relief warranted by that individual party’s claim, except that the arbitrator may issues injunctive and/or declaratory relief.
WHETHER THE CLAIM PROCEEDS IN ARBITRATION OR COURT, YOU AND BENSON’S AGREE TO WAIVE ALL RIGHTS TO BRING OR PARTICIPATE IN ANY CLAIMS AGAINST EACH OTHER THAT IS PART OF A REPRESENTATIVE OR CLASS ACTION PROCEEDING.
TO THE FULLEST EXTENT ALLOWABLE BY LAW, YOU AND BENSON’S EACH WAIVE THE RIGHT TO A JURY TRIAL.
12. Invalidity and Severability. If any provision of these Terms of Use is found invalid or unenforceable by a court of competent jurisdiction, then you agree that provision will be limited or eliminated, to the minimum extent necessary, so that these Terms of Use shall otherwise remain in full force and effect and enforceable.
13. Privacy. We are committed to protecting your privacy. Our Privacy Policy is available below, and is part of these Terms of Use and is incorporated herein by reference.

Benson’s Restaurant Group, LLC and its subsidiaries and affiliates (collectively, “Benson’s,” “we,” or “us”) respects concerns regarding how information about you (“Personal Information”) is used and shared, and we value our relationships with our guests. The following Privacy Policy (the “Privacy Policy”) describes the types of Personal Information that we may collect about you, how we may collect it, how we may use it, who we may share it with, and what choices you have regarding it. This Privacy Policy applies to your use of our internet and mobile websites (the “Websites”), the Benson’s mobile application (the “App” or “Mobile Application”), your participation in the Benson’s Rewards Program (“Benson’s Rewards”) and other online services (collectively referred to as the “Sites”), and other means by which we may collect Personal Information and other information from you, including information you may provide to us other than on the Websites, Sites, App, or via Benson’s Rewards. So that you may make informed decisions regarding your Personal Information, we strongly urge you to review this Privacy Policy completely and carefully.
From time to time, we may change this Privacy Policy. If we do, we will post an amended version. Please review this Privacy Policy carefully and periodically.
While acceptance of this Privacy Policy is voluntary, your continued use and/or participation in any of the foregoing constitute your acceptance of this Privacy Policy and any other applicable terms.
Personal Information You Provide
We may collect the following information:
Contact Information: This includes your name, email address, phone number, and mailing address.
Reservation Details: We collect information such as the date and time of your reservation, the size of your party, and any special requests you provide.
Loyalty Program Information: If you participate in Benson’s Rewards, we may collect your account details, purchase history, points and rewards information, and your birthday for promotional offers.
Gift Card Purchases: When you purchase a gift card, we collect the purchaser’s and recipient’s name and email address, along with payment details.
Account Information: This may include your name, email address, mailing address, phone number, credit card information, and billing address. Credit or debit card details used for orders, reservations, or gift card purchases are processed securely through third-party payment processors.
Location Information: We may collect precise or general location data (“Location Data”) as part of the functionality of the services. We collect Location Data in several ways from your wireless carrier and/or directly from the device on which you use the services. If you are accessing the services through the App, the way we collect Location Data will differ depending on your mobile device’s operating system. In all events, we do not collect Location Data, unless you have “allowed” its collection. If you decline to allow Location Data collection in the App, we will not collect your Location Data unless you manually enter it into the App.
Automatically Collected Personal Information
We automatically collect certain Personal Information through your use of the Websites, Sites, or App such as the following:
Device Information: This may include your IP address, browser type, and unique device identifiers.
Usage Data: We collect details about the pages you visit and the actions you take on our website or mobile app.
Cookies & Tracking Technologies: We use cookies and similar technologies for purposes such as analytics, personalization, and advertising.
How We Use Your Information
In addition to the purposes stated above, we may use Personal Information to:
Process reservations, orders, and gift card transactions.
Manage Benson’s Rewards accounts, points, and offers.
Communicate with you about your account, reservations, or orders.

We do not sell your Personal Information. We may share your information with:
Reservation platforms, payment processors, email and SMS marketing providers.
When necessary to comply with legal obligations or protect our rights.
With any other person or entity where you consent to the disclosure.
For any other purpose disclosed by us when you provide the personal data.
For any other purpose we deem necessary, including to protect the health or safety of others.
We do not share Benson’s Loyalty activity or order history with third parties.

We use cookies and similar technologies to improve user experience, analyze traffic, and deliver targeted advertisements. You can disable cookies in your browser settings, but some features may not work properly.
Children’s Privacy
We do not specifically target the Services to children under 13 years old. If you are under the age of 13, you should only use the Services under the supervision of a parent or legal guardian.

We implement commercially reasonable administrative, technical, and physical security safeguards to protect your Personal Information. However, please be aware that no method of transmission or storage is completely secure. Use caution when transmitting Personal Information over the Internet.

You can opt out of promotional emails or SMS by following the unsubscribe instructions in any message or by contacting us.

Security Methods and Fraud Prevention
All transactions are conducted in a secure environment to protect against fraudulent observation and/or use. We do not store your financial information, such as credit card information.
Any credit card information, or other related sensitive information, collected by Benson’s is first transmitted to Secure Socket Layer (SSL) technology and then encrypted in transmission. All authorized persons are required to keep information accessed via our database confidential. At our discretion, orders received over the phone or internet may require photo identification verification.
